Find a law that has been recently established in your state. Describe the background of the law. Was it created by legislative action, administrative agency, or through a constituency vote? Describe how this law will affect a health care organization.

Part 2- 400 words

Federal agencies are increasingly becoming active in investigating violations of health care laws. In addition, private lawsuits are surfacing on violations of health care laws. Find a recent case where there has been a violation of a health care law, such as a case involving fraud, privacy, or security. Discuss the following:

• What tort or criminal law was violated?
• Who was the investigating agency?
• Were there civil or criminal penalties and what were the penalties?
• In your opinion, was this a fair penalty for the violation that occurred?

Part 3- 400 words

With the HIPAA laws, much emphasis has been placed on the patient’s privacy rights and the requirements of the health care organization (a covered entity) to ensure privacy of protected health information. Discuss the following:

• When there is a breach of privacy, has a breach of fiduciary duty occurred?

Locate a case where a health care professional has been disciplined by the licensure board. Examine the issues, compare those issues with the professional ethics of that profession, and discuss the ethical violations that may have occurred in the conduct leading to disciplinary action.

Review and reflect on the knowledge you have gained from this course. Based on your review and reflection, write 100-200 words on the following:

Since the enactment of the Affordable Care Act, there have been several lawsuits in the federal courts, and some have made their way to the Supreme Court. Not all of these cases are accepted for appeal by the Supreme Court and thus are settled at the appellate court. Analyze a recent appellant court case related to a health care legal case. If possible, find a case in your own federal appellate court. Discuss the following in a 2-3 page paper not including the title page and reference page:

• In what court did this case originate?
• What is the law at issue in this case?
• What are the arguments supporting the law, and what are the arguments to overturn the law?
• Discuss the effect of this court case on health care delivery or operations. For example, will patient care be changed?
• How will the operations of a health care organization or health insurance company be changed?

Part 7 (2-3 pages)

You are working as the manager of a multispecialty clinic. You have been notified that a patient has filed a lawsuit against one of your physicians that has terminated a relationship with a patient. Executive management has asked you to prepare a memo to describe whether a patient can make a successful claim for a breach of contract in this case.

In this 2–3-page memo, discuss whether the physician-patient relationship is a contract and what needs to be shown for a breach of contract to have occurred.

You are currently working as an intern with the CEO of a large health system that includes inpatient facilities and ambulatory services including clinics, emergency room services, and outpatient services. The organization accepts government payers, commercial payers, managed care, and private pay. The CEO of your organization has asked you to provide an education session for the board of directors on their fiduciary duties.

Using at least 3 professional resources cited in APA format, prepare 6-8 slides not including title page and reference page with 150-200 word speaker notes that you will use to present to the board to explain at least 3 of the fiduciary duties of the board of directors of the health care organization.

Current legal and health care issues (use of medical marijuana, genomics, abortion, etc.) may create ethical and moral issues for the health care organization. Choose and identify an issue that may create ethical and moral issues for a faith-based organization.

• Examine the mission, vision, values and ethics of a faith-based health care organization and analyze the principles of the health care organization to propose how this organization may stand on a current legal and health care issue (please identify the issue you have chosen).
• Find at least 2 articles from the library that discuss the controversy of this issue that may be used to support the organization’s stance on this issue.
• Prepare a 3-4-page position statement or white paper not including title page and reference page that states the position of the health care organization for this issue.
